Who can sign the sale in Alabama
If the house is part of an estate, the personal representative appointed by the county probate court usually signs, using letters testamentary (when there's a will) or letters of administration (when there isn't). In Jefferson County the probate court has a Birmingham division and a Bessemer division. Shelby County's probate court sits in Columbiana. Alabama probate offices also record deeds, so the same office holds the house's title history.
If no estate was opened and the deed is still in the late owner's name, a title company will want that sorted out before closing. Sometimes that means opening an estate; sometimes the heirs can sign together. An Alabama probate attorney can tell you which applies.
Taxes to ask about
Alabama does not have a state inheritance tax. Federal tax rules often give inherited property a "stepped-up" basis, which can reduce capital gains when you sell. Property taxes and any mortgage still need to be paid while the house sits. A tax professional can tell you what applies to your family.
Heirs in different places, or who don't agree
When several heirs own the house together, all of them usually need to sign. Many closings can be handled by mail through a title company or closing attorney, so heirs who live out of state don't need to travel. If the heirs can't agree on selling, that becomes a legal question; talk to an attorney before signing anything.
Selling it as-is, belongings and all
Many inherited houses around Birmingham, Bessemer and Homewood have been lived in for decades and need updates. You don't have to fix anything or empty the house first. Take out documents, photos and anything of value, then tell us what's left. If the house is in good shape and the family has time, listing with an agent will often bring more money, and we'll say so.
